INFORMATION ON THE PROCESSING OF PERSONAL DATA (PRIVACY and GDPR)

(obligations related to Legislative Decree 30 June 2003, n. 196 – Privacy Code)

This privacy policy describes the processing of personal data entered or collected on the site www.bee1.it (hereinafter referred to as the “Site”). The policy also illustrates the processing of personal data entered or collected through third-party applications, platforms or sites (e.g. Facebook, Google analytics, Google Adwords, Get Site Control).

General Data Protection Regulation (GDPR)

Bee1 has read the legislation that replaces Legislative Decree 196/2003 (or Privacy Code) starting from 25 May 2018. In reference to this protocol for the management and processing of personal data, it has updated and integrated this information, as well as adapted all the processes and dynamics affected by the GDPR (both with regards to the Site and with regards to the physical point of sale).

Below we link the official and reference sources for the GDPR regulation, in order to make all the useful material to understand the dynamics regarding personal and sensitive data easily accessible.

Regulation document (in Italian) http://eur-lex.europa.eu/legal-content/IT/TXT/PDF/?uri=CELEX:32016R0679&from=IT

If the user finds anomalies or deficiencies (that have escaped our controls), we ask that you promptly report all the information to us, so that we can intervene promptly. We have always tried to protect the interests of both the User and the Customer to the maximum and at the same time provide an adequate, useful and efficient service for them: this also means having the maximum availability to correct any inaccuracies or oversights.

To implement this policy, we make available all the channels and functions we have to receive communications and reports on the matter: email info@bee1.it  and telephone number 045 690 1522.

Since Bee1 is a company that owns a physical point of sale as well as an e-commerce site, the adaptation has been duly extended to both environments. Therefore, the User and the Customer are informed that it is possible to request and view at any time the complete documentation - in addition to this Privacy Policy - relating to the processing of GDPR data relating to the company PIEFFE SPORT Snc di Rossignoli Francesco, Paolo & C by making a request to info@bee1.it or by going to the point of sale in Via Del Fiordaliso 10, 37051 Bovolone (VR).

Type of personal data collected

We collect two types of information: personal data and anonymous data. Additionally, we may use personal data and anonymous data to create a third type of information called aggregate data.

Below is the list and nature of the personal data collected on the Site:

  • registration data entered when the user creates an account, which includes or may include first name, last name, residential address, gender, date of birth, country of birth, e-mail address, username and password;
  • transaction data entered when the user completes the purchase of a product; these are linked to data that includes information on the products/services purchased, the postal address, tax code, telephone number and payment information;
  • personal data sent by a user within messaging systems, chat, posting messages or similar, where the activated service is permitted by applicable laws (e.g. Facebook Messenger);
  • personal data entered when using the Site or third-party websites, such as social networking sites, or when the user connects his/her profile on a third-party site or platform with the registration account;
  • location information about you when you visit our Site, including location information provided by a mobile device interacting with our Site or Applications, or your IP address, where the processing of such data is permitted by applicable law;
  • usage, viewing and technical data, including the user's device identifier or IP address, when the user visits the Site, uses our Applications on third-party sites and platforms, or opens our email messages.

How we collect personal data

We collect personal information you provide when you request products, services or information, or when you register on the Site, communicate with our customer care, respond to questionnaires or surveys, participate in a promotion, game, or contest, or otherwise interact with us.

Please note that when you provide personal information on third-party platforms or websites (for example, through our Applications), the information you submit may be collected separately by the third-party site or platform.

We collect personal information in accordance with the guidelines of this privacy policy; in addition, personal information collected by third-party sites and platforms is subject to the privacy policies of those third-party sites and platforms. The privacy choices you make on third-party sites and platforms do not apply to our use of personal information collected directly by us through our Applications.

When you register with your social media account, we will obtain the personal data you choose to share with us through these social media services based on their privacy settings. This may include your friends list and reviews from other users of your network. We may also use social media plug-ins on our Site or Applications. As a result, data will be shared with the social media service and possibly shared on your social media profile. Please refer to the privacy policies of these third-party social media providers to learn more about these practices.

We collect data through registration forms both within the Site and within third-party platforms (e.g. Facebook). The registration forms within the Site can be native (direct collection on proprietary systems), integrated via code (form embed), integrated via popup. In all cases, this privacy policy is clearly visible, clear and consultable - via a specific link - and is subject to free approval or refusal by the user.

The computer systems and software procedures used to operate the Site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of computers used by users who connect to the Site, URI (Uniform Resource Identifier) addresses of requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the operating system and the user's computer environment. This data is used for the sole purpose of obtaining anonymous (aggregated) statistical information on the use of the Site and to check its correct functioning and is stored for the times defined by the relevant legal regulations. The data could be used to ascertain responsibility in the event of hypothetical computer crimes against the Site.

We collect personal data through technological elements such as cookies, when the user visits our Site. Please read the Cookie Policy for further information, including how to disable cookies.

Purpose of data processing

Access to and navigation of the Site is free, but the possibility of using some online services available on the Site (e.g. the possibility of purchasing an item) is permitted only after the user has registered. The registration process consists of filling out an online form in which the user is asked to indicate his/her personal data - some of which must be entered - for the activation of authentication credentials (email + password) with which the interested party will subsequently access all areas and services of the Site reserved for registered users. Therefore, first and foremost, the primary purposes of the processing are represented by the need to allow the completion of the required prior online registration procedures and the creation of an account and to allow the Site managers to generate and subsequently manage technically and administratively (including the purposes of providing technical and commercial support and assistance upon request) the account, activation codes, passwords and similar authentication credentials to be used on the Site as created by users as part of the registration process.

Registered users, once authenticated on the Site, are then enabled to use all the services made available online on the Site. These services are divided into the following areas and can be used according to the separate contractual conditions available on the Site.

Therefore, the processing of personal data (including their registration in the Bee1 database) is aimed at achieving the following primary purposes:

  1. a) to ensure registration on the Site, allow the user to access some of the web pages of the Site where it is possible to use specific online services, ensure the correct provision of the services requested through the Site, and, therefore, to correctly and punctually fulfill all obligations arising from the contractual relationship established, as well as obligations arising from the law or regulations in force, in particular, in the tax and public safety fields;
  2. b) for administrative and accounting purposes, including the possible transmission by email of commercial invoices by Bee1 and/or companies associated with it in the provision of the service, for sending communications to the user regarding the account or transactions carried out with Bee1;
  3. c) finally, the primary purposes also include certain technical treatments carried out using the so-called "technical cookies" based on what is illustrated in more detail in the Cookie Policy. In these specific cases, the technical treatments are aimed solely at carrying out the transmission of a communication on an electronic communications network to the extent strictly necessary to provide the services explicitly requested by users.

In all the cases illustrated above in points a), b) and c), Bee1 is not obliged to acquire specific consent from the user. In fact, all the treatments illustrated above pursue primary purposes for which art. 24 of the Privacy Code excludes the need to acquire specific consent from the interested party, either because the treatment is necessary to fulfill an obligation established by law, by a regulation or by community legislation, or because the treatment is necessary to perform obligations arising from a contract to which the interested party is a party, or to fulfill, before the conclusion of the contract, specific requests from the interested party.

Should the user not intend to provide the personal data requested and necessary in accordance with the above, the consequence would be the impossibility of proceeding with registration on the Site and of using all the services for which registration and the provision of data are in any case technically and contractually necessary (e.g. the possibility of purchasing an item).

It would still be possible to navigate the Site as an unregistered and anonymous user and view only the contents and materials available without registration.

In compliance with the Privacy Code and the user's choices, the data may also be processed for the following additional secondary purposes:

  1. d) for registration on the mailing lists held by Bee1, the sending of advertising and information material on the products and services offered, solicitations to purchase by means of automated systems such as e-mail or by telephone with an operator (hereinafter collectively “Processing for Marketing purposes”);
  2. e) for the development of the customer's commercial profile (through the detection of consumer habits), aimed both at monitoring the level of customer satisfaction to ensure better satisfaction of their needs, and at sending informative and/or advertising material of specific interest to the customer, by means of automated systems, such as e-mail, fax, SMS or MMS, or by post.

In all the cases illustrated above in points d) and e), the data may be processed only in the event of specific consent. Failure to indicate consent will correspond to denial.

Therefore, by giving optional consent, the interested party specifically acknowledges and authorizes such further possible processing. In any case, even if the interested party has given consent to pursue the purposes mentioned in points d) and e), he/she will still be free to revoke it at any time, by sending a clear communication to this effect to Bee1 at the email/address info@bee1.it or through the dedicated links included in each newsletter sent.

Any refusal will not entail any consequences except the impossibility of being included in statistical and/or profiling analyses and receiving promotions, discounts and targeted communications, based on the data provided, or of being informed about any marketing and promotional-advertising initiatives. Therefore, for these additional purposes, processing will take place exclusively according to the purposes and on the basis of the specific consent given by the interested party when registering on the Site.

Important: It is reiterated that the primary and essential component in the purposes of use of personal data is the provision of the sales service in ways that are adequate for quality and efficiency. This also includes a fast and effective assistance service, which requires having data that can facilitate customer care activities both with the customer and in the relationship with suppliers (e.g. couriers in the event of poor service, communications relating to specific deliveries, etc.).

Data processing methods

The processing of personal data will be mainly carried out with the aid of electronic or automated means, according to the methods and with the tools suitable to guarantee the security and confidentiality of the data, in compliance with the provisions of Legislative Decree 196/2003. In particular, all technical, IT, organizational, logistical and procedural security measures will be adopted, as provided for by Legislative Decree 196/2003, so that the minimum level of data protection required by law is guaranteed, allowing access only to the persons in charge of processing by the Data Controller or the Managers designated by the Data Controller.

Data storage methods and usage times

The data collected through the Site are stored within digital environments:

  • protected by unique passwords for each member of Team Bee1
  • subject to periodic encryption
  • monitored with log tracking to ensure useful information when needed

Data collected through third-party platforms are protected by unique passwords for each member of Team Bee1

We also change access passwords periodically for security reasons, as well as conduct a quarterly internal audit to verify that there are no anomalies or new developments in the data collected that require the integration of this Privacy Policy and internal documents relating to the GDPR.

Both for sales purposes (e.g. dialogue with the Courier) and for assistance purposes, Bee1 intends to retain the data collected and stored for an indefinite period. The basis of this lies in the need - proven over the years of operation - to be able to draw on the history of each user/customer and their purchases in order to:

  • To be able to provide an efficient and useful service
  • Trace and identify any misunderstandings during the purchasing phase
  • Demonstrate any misunderstandings or evidence of specific issues that have led to problems of any kind
  • Have material that can be requested from product suppliers (e.g. Nike, adidas, etc.) regarding defective batches, returns for product malfunctions, recalls of specific items, product traceability, etc.
  • For online marketing and advertising purposes, Bee1 intends to retain the collected data for the duration that the platforms used allow.

The basis of this lies in the need - given the statistical nature of this activity - to collect and cross-reference as many aggregated (and therefore anonymous) data as possible in order to improve the quality of promotional activities both from a sales perspective and from the perspective of appreciation and interest by users/customers for the proposed contents.

OWNER AND DATA CONTROLLER

The Data Controller is PIEFFE SPORT Snc di Rossignoli Francesco, Paolo & C with registered office in Via Del Fiordaliso 10 37051 Bovolone. The designated Data Controller can be reached by writing an email to info@bee1.it or by calling 045 690 1522.

RIGHTS OF THE INTERESTED PARTY

Finally, we remind you that art. 7 of Legislative Decree 196/2003 grants the interested party the exercise of specific rights, including those of obtaining confirmation of the existence or otherwise of their personal data even if not yet registered, communication of the same data in an intelligible form, their origin, the purposes and methods of processing as well as the logic applied in the event of processing carried out with the aid of electronic instruments.

The interested party may also obtain the updating, rectification or, if there is interest, the integration of the data as well as the cancellation, transformation into anonymous form or blocking of data processed in violation of the law.

The interested party also has the right to object, in whole or in part, for legitimate reasons, to the processing of his/her personal data even if pertinent to the purpose of the collection or for commercial communications, for the sending of advertising material or for direct sales.

Important: The user is free at any time to know what data we collect, how we store and protect it, and how it is used. He is also free at any time to request partial or total cancellation of it through different methods: features on the Site, on the forms/mailing services used by us, direct communication with our customer service through any channel (e.g. Facebook Messenger, email, telephone, etc.). Our goal is to facilitate in any way the viewing and awareness of the use of the user's data and give the possibility to intervene at any time in the consents/refusals of use.
